Misrepresentation is the act of a Party providing false or misleading to another Party.

When they enter a contract together, this mislead Party suffers a loss as a result. 

Misrepresentation can occur in three different ways: 

  • Fraudulent - the. misrepresentation was made knowingly
  • Negligent - reasonable care was not taken to ensure the representation was accurate
