Condition of a Contract

A Condition of a Contract is an essential or fundamental Term in a Contract.

A condition of the contract is a requirement and one or both parties must comply. 

Conditions of a contract can be expressed or implied.

An express condition is one that has been explicitly stated in a contract.

An implied condition is not specifically written out, but the law could assume certain conditions exist. 

Failure of a Condition may result in Breach of Contract.
